The general conditions of sale indicated here (hereinafter “General Conditions”) apply to all the sales (hereinafter “Services” or singularly “Service”) provided by La Cort, through its domain www.lacortstore.com (hereinafter “Site”).

The use of the Services is permitted exclusively to those who have read the Information on the policy of confidentiality and protection of personal data and accept the General Conditions.

Pursuant to and for the purposes of Articles 7 and 12 of Legislative Decree no. 70 of 9/04/2003, La Cort communicates to the users that the provider of the Services subject to the General Conditions is La Cort di Clochiatti Caterina, whose registered office is at Via Beorchia no. 18, 33100 Udine, Italy, P.iva 03126910300, C.F. CLCCRN81S57L483D; pec lacortsas@pec.it; registered at the Chamber of Commerce of Udine with registration no. 370784 (hereinafter “La Cort”).

1. SCOPE OF APPLICATION

1.1 The General Conditions apply to all the sales made by La Cort on the Site. The non-acceptance of the General Conditions carries with it impossibility of effecting purchases on the Site.

1.2 The General Conditions may be modified at any time, subject to your right of withdrawal referred to in paragraph 1.4.

1.3 The General Conditions applicable are those in force at the date on which the order is submitted.

1.4 In the event that the user does not intend to accept the modifications to the General Conditions shall have the right to withdraw by giving notice by means of registered letter with acknowledgment of receipt or email within 7 days of the notice of such changes.

1.5 The continued use of the Service after the termination of the period referred to in paragraph 1.4 shall be deemed to indicate the willingness to accept the General Conditions.

1.6 In case of disputes the competent court, pursuant to Article 63 of the Consumer Code (Legislative Decree no. 206/2005), is that of the place of residence or of domicile of the user.

 

2. REGISTRATION TO THE NEWSLETTER AND CREATION OF AN ACCOUNT

2.1 To receive the periodic newsletter it is necessary to register to the Site by entering only an Email (hereinafter the “Credentials of Registration”), and then confirm the Email sent from La Cort. By subscribing you agree to the terms of our privacy policy. La Cort does not knowingly collect information from users under the age of 16 directly.

2.2 Creation of an account on the site is free. To create it, the user must complete the module of registration by entering an Email address and a password (hereinafter the “Credentials of Registration”). The registration will be confirmed to the Email address provided by the user. By subscribing you agree to the terms of our privacy policy. La Cort does not knowingly collect information from users under the age of 16 directly.

2.3 The Credentials of Registration must be utilised exclusively by the user and may not be ceded to third parties. The user must notify La Cort without delay in the event of their suspected misuse. The Credentials of Registration may be modified by the user at any time through the on-site access.

2.4 The user guarantees that the Credentials of Registration provided during the procedure of registration to the Site are complete, correct, and true. The user agrees to hold La Cort harmless of any indemnifiable obligation or sanction deriving from and/or in any way related to the breach by the user of the rules of registration to the Site. The user is exclusively responsible for the access to the Site through the use of the Credentials of Registration, and is liable for any damage or injury arising to La Cort or to third parties resulting from the misuse, loss, misappropriation by others, or otherwise from the failure to adequately protect the confidentiality of their Credentials of Registration. All the operations carried out through the use of the Credentials of Registration will be considered to have been effected by the user to whom the Credentials of Registration refer.

2.5 The user may at any time cancel their registration to the newsletter or the account by unsubscribing or sending an Email addressed to info@lacortstore.com.

 

3. TERMS AND CONDITIONS OF PURCHASE

3.1 All prices on the Site are expressed in Euros. The delivery charges are explicitly stated. This amount will be shown separately on the order form. We inform users that for deliveries outside the Italian territory, the costs of delivery may be higher, and may vary depending on the destination and the volume/weight of the package.

3.2 Orders are accepted through the Internet (online). For other types of orders or requests via telephone or Email, La Cort reserves the right to apply specific conditions of sale.

3.3 At the time of purchase, certain data will be requested that is necessary to be able to proceed with the order and the subsequent delivery. The user must complete the module by entering their surname, name, Email address, telephone number, country, address, date of birth or VAT registration number (hereinafter the “Credentials of Registration”) and agreeing to the General Conditions.

3.4 The user making the order will receive, on completion of the procedure, an order confirmation via electronic mail (Email).

3.5 The user guarantees that the Credentials of Registration provided during the procedure of registration to the Site are complete, correct, and true. The user agrees to hold La Cort harmless of any indemnifiable obligation or sanction deriving from and/or in any way related to the breach by the user of the rules of registration to the Site. 3.6 The Customer have the possibility to send the purchase to other person and/or other address; select the option Ship to a different address and complete the module.

3.7 The purchase of a gift card is purely virtual; after the purchase, in addition to receiving the order confirmation, a coupon code will also be sent directly to the Email address indicated, to be used when making the checkout. The gift card is offered in various denominations, and has a validity of 12 months from the time of purchase. It can be used in a single transaction, and does not give the right to any change.

3.8 The Products shall remain the property of La Cort until such time as the payment of the purchase price and the delivery costs has been made by the Customer. La Cort will proceed to fulfil the order only after having received confirmation of the payment of the total amount due as indicated in the order.

3.9 Prices are as set out on the website. We reserve the right to alter prices at any time. It may be necessary to change prices either up or down, from time to time. Any price changes will be confirmed to you at the time of ordering.

 

4. PAYMENT

4.1 The payment for goods must be made using one of the following methods as chosen by the Customer: Bank Transfer (to be made within five working days following the date of receipt of the order confirmation by Email, otherwise La Cort may exercise the right to cancel the order); PayPal account or Credit Card using the PayPal portal. You can link a debit or credit card to your PayPal account without make a registration (it is enough an Email address and a password).

PayPal is authorised to receive payments from all major Credit Cards and Prepaid Cards without the necessity of having to make a registration. PayPal is committed to handling your customer information with high standards of information security. Every transaction is subject to procedures not linked to our Website. PayPal will not sell or rent your information to third parties for their marketing purposes without your explicit consent.

If you open a PayPal account directly on a third-party website or via a third party application, any information that you enter on that website or application (and not directly through the PayPal Services) will be shared with the owner of such third party website or application and your information may be subject to their privacy policies. 4.3 The payment receipt relating to the order will be sent to the electronic address communicated by the Customer at the time the order was made.

5. EXPRESS TERMINATION CLAUSE

In the event of the failure to pay all or part of the purchase price of the goods, La Cort reserves the right to declare the contract terminated, pursuant to and by the effects of Article 1456 of the Civil Code, through the sending of a written communication to the Email address of the user.

 

6. DELIVERY

6.1 The expected delivery times, calculated from the day of payment, are variable and non-binding. They are specified within the page of the individual product or package.

6.2 In case of “Customised Orders” the delivery times may vary.

6.3 La Cort does not take orders and does not make deliveries on the following days: 1st and 6th January, Easter Monday, 25th April, 1st May, 2nd June, 1st November, 8th December, and 25th – 26th December.

6.4 The goods will be sent by express courier to the delivery address indicated by the Customer at the time of making the order. Please remember that it is possible to enter a delivery address different from that of the Customer’s residence, such as that of the workplace or of a neighbour.

6.5 La Cort will make deliveries from Monday to Friday, during the hours from 9 am to 6 pm, by express courier; the user can in any case follow the course of their package with the tracking number that will be communicated to them by Email. In the event of a delivery failure due to the absence of the recipient at the address indicated by them in the order, the courier will leave a notice certifying the delivery attempt. The recipient will be required to recontact the courier to agree a method of collection or delivery within 7 days of the date of the notice, otherwise the package will be returned to La Cort. Any restocking expenses will be the responsibility of the Customer.

6.6 Upon delivery of the goods by the courier, the Customer is required to verify that the packaging is not damaged or otherwise altered, including the sealing materials. Any damage to the packing and/or the product must be immediately disputed by the Customer at the time of delivery, by writing “goods unchecked” and specifying the reason for the concern on the courier’s delivery document. If the delivery document is signed without following this procedure, then the Customer can no longer dispute the condition of the product delivered.

6.7 Delivery will be made by express courier throughout the Italian territory and in the following countries: Austria, Slovenia, Germany, Swiss, France, Luxembourg, the Netherlands, Belgium, Denmark, Great Britain, Ireland, Spain, Czech Republic, Slovakia, Poland, Romania and Hungary. 6.8 To provide the Website and our services, we work with a number of carefully selected third parties. To do this, we may share your information with these third parties in the following limited circumstances: we employ other companies to perform functions on our behalf including fulfilling orders, delivering packages, sending customer communications, analyzing data, processing credit card payments and providing customer service.

They have access to personal information needed to perform their functions, but may not use it for other purposes. We do not sell to third parties personal data.

 

7. CONFORMITY OF PRODUCTS / WARRANTIES

7.1 The products offered on the Site comply with national and European legislation in force in Italy.

7.2 The description of the products offered on the Site are those that the suppliers, under their own responsibility, have communicated to La Cort. La Cort is not responsible if the product ordered does not correspond to its description on the Site, in cases where the lack of correspondence derives from errors of the description imputable to the supplier and of which La Cort was not and could not have been aware with due diligence.

7.3 All the products sold on the Site are covered by the Legal Guarantee of Conformity provided for under Articles 128-135 of the Consumer Code (“Legal Guarantee”). Specifically, the Customer, in accordance with Article 130 paragraph 2, must report the lack of conformity to La Cort within two months from the date on which the defect was discovered. This is without prejudice to the fact that La Cort is responsible for a period of two years from the delivery of the goods.

7.4 In the event that a product is delivered that does not conform or suffers from a latent defect, La Cort undertakes to reimburse the Customer for the full price of the product, or at their choice, to deliver a product identical to the one ordered, if available, or otherwise one of equivalent quality and price.

7.5 Products that have been repaired, modified, or altered in any way by the Customer are excluded from the Legal Guarantee. Also excluded from the scope of application of the Legal Guarantee are any failures, malfunctions, or defects of any type resulting from events which are accidental or which are the responsibility of the Customer, or otherwise arise from a use of the product that does not conform to its intended use and/or the use provided for in the technical documentation attached to the product, where applicable, or in the instructions of use relating to the product.

 

8. RIGHT OF WITHDRAWAL

8.1 The Customer may revoke the fulfilled order, exercising the right of withdrawal provided for by Article 52 of the Consumer Code (Legislative Decree no. 206/2005), within a period of 14 (fourteen) days from the delivery of the goods, without having to provide any reason and without incurring any penalty.

8.2 The Customer may withdraw from the contract by communicating such a decision to La Cort, by means of a registered letter with acknowledgment of receipt addressed to the registered office of La Cort, or by Email to: customercare@lacortstore.com, detailing the product/s, and the relative order number that was indicated in the order confirmation sent by Email. In either case, the burden of proof for the receipt of such communication is the responsibility of the user.

8.3 The Customer has the obligation to return the goods already delivered to La Cort; the costs of delivery and return remain their responsibility. The return will have to be made within 14 (fourteen) days from the date of our email of authorization, which will indicate the procedures to follow.

8.4 La Cort will reimburse the payment of the product/s returned within 14 (fourteen) days of receipt of the return. In the event of partial withdrawal, only the price of the returned products will be reimbursed.

8.5 Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply for the supply of goods that have been made to measure or clearly personalised.

8.6 Are accepted only returns of unused or not damaged (except damages with the shipping) items.

10.1 The contents of the Site, such as, but not limited to, the works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material in whatever format published on the Site, including the menus, web pages, graphics, colours, schemes, tools, characters and design of the web site, diagrams, layouts, methods, processes, functions and software, are protected by copyright and every other intellectual property right of La Cort and of the other owners of the rights. The reproduction, modification, duplication, copying, distribution, sale or other exploitation of the images, of the contents of the Site is prohibited. It is, furthermore, prohibited to make use of the contents of the Site in any way for commercial interests and/or publicity.

10.2 All the other hallmarks that distinguish the products sold on the Site are registered trademarks of their respective holders and are used by La Cort under license, for the sole purpose of distinguishing, describing, and publicising the products for sale on the Site. Any use of the hallmarks mentioned above does not comply with the law and, being unauthorised, is prohibited. Nor is it permitted to use any of the hallmarks present on the Site in any way to take unfair advantage of their distinctive character or reputation, or to be detrimental to them and their owners.
